The court of cassation with an order confirmed the above-mentioned judgments, which denied compensation to the patient who, after sitting alone on a hospital bed, fell on the ground and reported serious injuries.

Therefore, it is not possible to represent a failure by the healthcare staff and, consequently, a compensation, when patients are seated independently on the hospital bed and then fall.

In this case, the patient, while waiting for an ultrasound scan, has voluntarily tried to sit on the couch without being helped by the staff. That is why, for the sixth civil section of the Supreme Court, there is no possibility of compensation for the lady.
