The recent judgment of the Supreme Court, no. 17794/2017, is clear: who occupies the allocated parking for the disabled is not only sanctioned by the Highway Code but also by the Criminal Code, because what is violated is Article. 610 c.p, private violence.

In the present case, the Supreme Court has rejected the appeal of the accused which, occupying the place of a disabled person suffering from serious diseases, he obstacolated its use: the ratio legis of Article. 610 of the Criminal Code, in fact, is based on the need to suppress coertions not covered by other laws, in order to protect the people’s moral and physical freedom.

Why  not only the Highway code violation? This law punishes only those who occupy a parking space generally reserved for the disabled. In this case, however, the space was destined for a disabled person precisely identified,  that’s why we have both the violation of the Highway Code and the Criminal Code.
