Animal Rights: after seize, who is the subject to which their safekeeping is entrusted?
The increasingly relevance recognised to the role among society of the animals involves also the legal and juridical field
The Supreme Court, in a judicial proceeding, concerning seized or confiscated animals because of maltreatment, identified (with judg. No. 18167/2017 of 11 April 2017) the person who must take care of these animals.
Italian law provides that the animals, in these cases, are entrusted to specific association, however, when these subjects are missing, for the Supreme Court will be the Mayor to ensure maintenance and care the abused animals.
The judges, according to the recent ruling, consider the Mayor as a true guarantor of the welfare and rights of all the animals which are on the municipal territory, which is why he will be obliged to provide for their care and maintenance.
